NIA Code of Ethics and Professional Conduct

The goal of NIA is to provide an environment for like-minded people to develop professional relationships and explore business opportunities.  NIA’S objective is to be a positive catalyst for each member in business networking, sales performance, and professional capabilities.

This Code is designed to inspire and guide the ethical conduct of all NIA members. Additionally, the Code serves as a basis for remediation for violations. The Code includes principles formulated as statements of responsibility, based on the understanding that member comfort, success, and satisfaction is the primary consideration of all actions.

1. GENERAL ETHICAL PRINCIPLES.

1.1 All members must act ethically.

This principle, which concerns the quality of member interaction, affirms an obligation of NIA members, both individually and collectively, to use their experience and connections for the benefit of all members. Member interaction must display the highest principles of honesty, courtesy, fair practice, and professional decorum. Members will attend meetings to conduct business relevant to their professions and exemplify high professional behavior standards in their fields of work. NIA members should consider whether the results of their efforts will respect diversity and provide a safe social environment.

1.2 Avoid harm.

In this document, “harm” means negative consequences, especially when those consequences are significant and unjust. Examples of harm include unjustified physical or mental injury, unjustified destruction or disclosure of information, and unjustified damage to reputation and the environment. 

1.3 Be honest and trustworthy.

NIA members should be honest about their product or service offerings, qualifications, and any limitations in their competence to complete a task. NIA members should be forthright about any circumstances that might lead to either real or perceived conflicts of interest with other members. Furthermore, all commitments should be honored or adjusted to assure mutual member satisfaction.

1.4 Be fair and act not to discriminate.

The values of equality, tolerance, respect for fellow NIA members, and justice govern this principle. NIA members should foster fair participation of all, including those of underrepresented groups. Prejudicial discrimination based on age, color, disability, ethnicity, family status, gender identity, labor union membership, military or veteran status, nationality, race, religion or belief, sex, sexual orientation, political affiliation or any other inappropriate factor is an explicit violation of the Code. 

1.5 Respect the work required to produce a connection and new ideas.

Members will treat all information concerning the business affairs of other members as strictly confidential. Developing new ideas, inventions, creative works, and computing artifacts create value, and those who expend this effort should expect to gain any value attributable to their work. NIA members should therefore credit the creators of ideas, inventions, work, and artifacts and respect copyrights, patents, trade secrets, license agreements, and other methods of protecting authors’ works. NIA members should not claim private ownership of work that they or others have shared as public resources.

1.6 Respect privacy.

The responsibility of respecting privacy applies to NIA members in a particularly profound way. Technology enables the collection, monitoring, and exchange of personal information quickly and often without the knowledge of the people affected.  NIA members should only use personal information for legitimate ends and without violating the rights of other members. As an organization, NIA, through its member directory, has transparent policies that allow all individuals to understand what data is being collected and how it is being used, to give informed consent for automatic data collection, and to review, obtain, correct inaccuracies in, and delete their personal data.

1.7 Honor confidentiality.

NIA members are often entrusted with confidential information such as trade secrets, client data, nonpublic business strategies, financial information, research data, pre-publication scholarly articles, and patent applications. NIA members should protect confidentiality except in cases where there is evidence of the violation of law, organizational regulations, or the Code. In these cases, the nature or contents of that information should not be disclosed except to appropriate authorities, or executive management in the case of a Code violation. A NIA member should consider thoughtfully whether such disclosures are consistent with this Code.

2. PROFESSIONAL PRINCIPLES.

2.1 Maintain high standards of professional 

High-quality member interaction depends on individuals who take responsibility for their professional competence. At NIA, we believe professional competence starts with business and technical acumen and requires communication skills, reflective analysis, and recognizing and navigating ethical challenges. Peer NIA members’ success, as defined by stated expectations and goals—including customers, colleagues, and others affected directly or indirectly—should always be the central focus in member interaction, conduct, and ethical practice.

2.2 Manage resources to enhance the quality of working life.

Members should ensure that they enhance, not degrade, the quality of working life for their peer members. Consideration for all member interaction should include the personal and professional expected outcomes, development, accessibility requirements, physical safety, and psychological well-being. 

2.4 Create opportunities for all members.

Broadly defined, opportunities are essential for all NIA members. The leadership of NIA is committed to ensuring that opportunities are available to NIA members to help them improve their knowledge and skills, networking connections, and overall business performance. NIA members should be aware of oversimplified approaches, the improbability of anticipating every possible condition, and the inevitability of unproductive referrals/connections. There is a balance in setting expectations that result in a positive experience and the actual time and effort to meet commitments. NIA may provide training in networking, communication, and time management to ensure each member is provided with an opportunity to expand their business success.

2.5 Uphold, promote, and respect the principles of the Code.

The future of NIA depends on professional and ethical excellence. NIA members should adhere to the principles of the Code and contribute to improving them. NIA members who recognize breaches of the Code should take actions to resolve the ethical issues they identify, including, when reasonable, expressing their concern to the person(s) thought to be violating the Code.

2.6 Treat violations of the Code as inconsistent with membership privilege.

Each NIA member should encourage and support adherence to this Code of Ethics and Professional Conduct.  NIA members who recognize a breach of the Code should consider reporting the violation to the NIA Franchise owner, which may take action that may include, but are not limited to, suspending or terminating membership privileges or access.

Network In Action Franchise, INTL. seeks to ensure that it retains only data necessary to effectively conduct its program activities and work in fulfilment of its mission.

The need to retain data varies widely with the type of data and the purpose for which it was collected. Network In Action Franchise, INTL. strives to ensure that data is only retained for the period necessary to fulfil the purpose for which it was collected and is fully deleted when no longer required. This policy sets forth Network In Action Franchise, INTL's guidelines on data retention and is to be consistently applied throughout the organization.

Scope

This policy covers all data collected by Network In Action Franchise, INTL. and stored on Network In Action Franchise, INTL. owned or leased systems and media, regardless of location. It applies to both data collected and held electronically (including photographs, video and audio recordings) and data that is collected and held as hard copy or paper files. The need to retain certain information may be mandated by federal or local law, federal regulations and legitimate business purposes, as well as the EU General Data Protection Regulation (GDPR).

Reasons for Data Retention

Network In Action Franchise, INTL. retains only that data that is necessary to effectively conduct its program activities, fulfill its mission and comply with applicable laws and regulations.

Reasons for data retention include:

  • Providing an ongoing service to the data subject (e.g. sending a newsletter, publication or ongoing program updates to an individual, ongoing training or participation in Network In Action Franchise, INTL.s programs, processing of employee payroll and other benefits)
  • Compliance with applicable laws and regulations associated with financial and programmatic reporting by Network In Action Franchise, INTL. to its funding agencies and other donors
  • Compliance with applicable labor, tax and immigration laws
  • Other regulatory requirements
  • Security incident or other investigation
  • Intellectual property preservation
  • Litigation

Data Duplication

Network In Action Franchise, INTL. seeks to avoid duplication in data storage whenever possible, though there may be instances in which for programmatic or other business reasons it is necessary for data to be held in more than one place. This policy applies to all data in Network In Action Franchise, INTL.s possession, including duplicate copies of data.

Retention Requirements

Network In Action Franchise, INTL. has set the following guidelines for retaining all personal data as defined in the Institutes data privacy policy.

Website visitor data will be retained as long as necessary to provide the service requested/initiated through the Network In Action Franchise, INTL. website.

  • Contributor data will be retained for the year in which the individual has contributed and then for 5 Years after the date of the last contribution. Financial information will not be retained longer than is necessary to process a single transaction.
  • Event participant data will be retained for the period of the event, including any follow up activities, such as the distribution of reports, plus a period of 5 Years;
  • Program participant data (including sign in sheets) will be retained for the duration of the grant agreement that financed the program plus any additional time required under the terms of the grant agreement.
  • Personal data of subgrantees, subcontractors and vendors will be kept for the duration of the contract or agreement.
  • Member data will be held for the duration of membership and then 5 Years after the last day of membership.
  • Data associated with employee wages, leave and pension shall be held for the period of employment plus 5 Years, with the exception of pension eligibility and retirement beneficiary data which shall be kept for 5 Years.
  • Recruitment data, including interview notes of unsuccessful applicants, will be held for 5 Years after the closing of the position recruitment process.
  • Consultant (both paid and pro bono) data will be held for the duration of the consulting contract plus 5 Years after the end of the consultancy.
  • Board member data will be held for the duration of service on the Board plus for 5 Years after the end of the members term.
  • Data associated with tax payments (including payroll, corporate and VAT) will be held for 5 Years.
  • Operational data related to program proposals, reporting and program management will be held for the period required by the Network In Action Franchise, INTL. donor, but not more than 5 Years.

Data Destruction

Data destruction ensures that Network In Action Franchise, INTL. manages the data it controls and processes it in an efficient and responsible manner. When the retention period for the data as outlined above expires, Network In Action Franchise, INTL. will actively destroy the data covered by this policy. If an individual believes that there exists a legitimate business reason why certain data should not be destroyed at the end of a retention period, he or she should identify this data to his/her supervisor and provide information as to why the data should not be destroyed. Any exceptions to this data retention policy must be approved by Network In Action Franchise, INTL.s data protection offer in consultation with legal counsel. In rare circumstances, a litigation hold may be issued by legal counsel prohibiting the destruction of certain documents. A litigation hold remains in effect until released by legal counsel and prohibits the destruction of data subject to the hold.

Recruitment has commenced for the PERM Labor Certification position of Franchise Area Developer. Our goal is to run all recruitment concurrently during the 32 days that the State Workforce Agency (SWA) Job Order is running to enable us to file the application by the earliest filing date. The earliest we can file the PERM application is 30 days post the last day of recruitment. The filing deadline is 11/9/2018.
The recruitment schedule is as follows, please note that the forms of recruitment listed in red require your attention:

  1. *Internal Notice of Filing. Please post the notice in a conspicuous location at the worksite for ten (10) consecutive business days (excluding weekends and federal holidays). Please let us know once the notice has been posted so we can calendar the dates and notify you when it should be taken down.
  2. Job Order with State Workforce Agency The job order has been posted with the Texas Workforce Commission. It will run for at least 32 days from May 14, 2018 to June 15, 2018.
  3. Sunday Print Ads –  The 2 Sunday ads were scheduled as follows: Sunday (5/20/18) and Sunday (5/27/18).
  4. Online Ad  The ad was scheduled to run concurrently for two weeks beginning with the Sunday ads, there is no additional cost for this ad.
  5. Employer Website Ad   Please let us know once the ad has been placed on your company website to enable us the capture the screen shots as proof of advertisement. Please delete heading before posting.
  6. Radio Ad –   The cost for the 30-second iHeart Media radio ad is approximately $300.00, our accounting department will send an invoice for payment if you approve this form of recruitment.

NIA Rules And Regulations | Policies

There is an initial application fee that covers your background check, business assessment, intro video and hosted profile page. Once the fee is submitted it is nonrefundable.

Fees are nonrefundable. In rare instances, a credit can be given, upon request, to members who are forced to give up their place in the group for the unused portion of their time.

Fees in the group are transferable with prior written notice. Typically this would occur when one person from a member company is replacing another person in the same group and employed with the same company.

NIA is a referral group provided by NIA Intl. LLC. NIA and any of our franchise owners reserve the right to discontinue a member’s participation in the group. If a member feels as if they have been unduly removed they are allowed to provide a written request to NIA LLC. To be reinstated.

Communication

By entering into a membership contract agreement with Network In Action, members Receive periodic messaging in the form of text and / or email. The content of these messages include, but are not limited to:

  • Added value content
  • Referrals and connections initiated by other Network In Action Members within your group.
  • Event Reminders

Termination

Network In Action leaders reserve the right to terminate or suspend membership for reasons including, but not limited to: repeat disruptions within the group, repeat absenteeism, criminal activity or failure of payment. If your membership is terminated, you may submit your appeal to info@networkinaction.com with the subject line “Termination Appeal”. Please provide the details surrounding your termination in the body of the email. Once reviewed, we will respond with our final judgment regarding the matter.

Attendance

Your attendance is critical to the success of the group. Since we meet 12 times annually meeting attendance is even more critical. 100% attendance is expected. On the rare occasions which you do have to miss you are expected to send a replacement. Missing a meeting and not sending a replacement costs your fellow member's business. Adherence to the attendance policy will be enforced.

Multi-Level Marketing

Members of NIA can represent their products or services but not the business opportunity element of their business.

Dues On Payment Plan

Your NIA franchise owner may choose to offer members the opportunity to spread payments out over semiannual, quarterly, or monthly payments. Since we are in the business of “Creating Relationships That Last A Lifetime,” we only offer annual memberships. Payment plans are executed on an automated draft. If for any reason you leave the group or are asked to leave the group prior to the end of your 12 month commitment, you remain responsible for the remainder of the dues obligation. The franchise owner may fill your seat in the group before the end of your annual commitment. In that instance and only then will you no longer be responsible for dues owed. The franchise is not obligated to fill that position.

The NIA ROI Guarantee

NIA is the only organization of its kind that offers an ROI guarantee on each member’s investment. There is a trade-off on this partnership. A member must attend 11 of the12 meetings during the term of their contract. Additionally, the member must pass 12 legitimate referrals during the course of the year on the NIA system. Members also must go online regularly and close their own business on the system. In return for these efforts, there is a certain amount of return a franchise owner can offer to guarantee. Should this number not be hit during the first 12 months the member is entitled to a second year at no cost. The member still must attend all meetings and pass a minimum of 1 referral a month or they may be replaced in the group during the second year.
